Is this a ticket, or is this a criminal charge?

Look at the citation the officer handed you. If the box is checked for an infraction, that piece of paper is not a crime. It carries no jail, you cannot be arrested for it, and in many cases you should handle it yourself without hiring anybody. If it is checked as a misdemeanor, you have been criminally charged, that citation is your notice to appear, and a conviction stays on your record permanently.

Here is the part almost nobody knows, and it is the reason this page exists. A citation written as an infraction is not final. The prosecutor can still upgrade it before it is ever filed. We have watched a client’s infraction citation for driving on a suspended license turn into a charge carrying mandatory jail time, without the client doing anything at all.

We are The Law Offices of Bryan R. Kazarian, a criminal defense firm in Santa Ana handling driving offenses across all four Orange County justice centers. This page covers the non-DUI driving charges: driving on a suspended license, driving without a license, reckless driving, hit and run, and evading. If your case involves alcohol or drugs, start at our Orange County DUI page instead.

Talk to us about your citation, free and confidential

The upgrade nobody warns you about

When an officer writes you a citation, that is not the filing decision. It is a recommendation. What happens next depends on a routing choice inside the agency that you never see and are never told about.

There are two paths:

  1. The police agency direct files it. The charge stays exactly as written on the citation. If it was written as an infraction, it stays an infraction. Prior convictions in your history never get attached to it.
  2. The District Attorney reviews it first. Now a prosecutor is reading your driving history alongside the citation. If your record supports a more serious section, they can charge that section instead.

Same conduct, same piece of paper, two completely different cases. On a driving on a suspended license citation, that difference can be the difference between a fine and a mandatory jail sentence.

Bryan Kazarian on how the firm handles it:

On catching the upgrade before it happens

“We monitored this citation to determine if the case was going to be filed by the district attorney, or direct filed by the police agency. If it was direct filed by the police agency, it would have stayed as an infraction and prior allegations and/or convictions would not have attached, therefore not causing an enhanced punishment.”

Bryan R. Kazarian Criminal defense attorney, Santa Ana

That monitoring is work that happens before there is a case number, before an arraignment, and before most people think a lawyer is necessary. It is also the window where a driving offense is easiest to fix, because nothing has been filed yet.

CHARGED WITH A CRIME?

Schedule Here

What these charges actually are

Four charges make up most of what walks through our door, and they are not equally serious.

Driving on a suspended or revoked license

There are four sections, and which one you are charged under changes everything:

Section What it means
SectionVC 14601 What it meansSuspended for reckless driving or a negligent operator finding
SectionVC 14601.1 What it meansThe general suspension section
SectionVC 14601.5 What it meansSuspended for refusing or failing a chemical test, or when the DMV suspends after a loss at an APS hearing
SectionVC 14601.2The bad one What it meansSuspended for a DUI conviction. This is the section Orange County will not reduce, and the only one of the four carrying a mandatory jail minimum.

All four are misdemeanors, and all four put two points on your DMV record. A VC 12500, driving without a valid license, carries zero.

All four are misdemeanors and all four put two points on your DMV record.

A 14601.2 conviction carries a mandatory minimum of 10 days in county jail and a fine starting at $300 plus penalty assessments. If you have a qualifying prior within five years, the minimum jumps to 30 days in the Orange County Jail and a fine starting at $500 plus assessments. Those minimums are written into the statute. A judge does not get to waive them.

Every one of these sections also requires the prosecutor to prove you knew your license was suspended. That element is where these cases are won, and it is missing from most of the competing pages you will read on this subject.

Driving without a valid license

VC 12500 is a wobblette, meaning it can be charged as a misdemeanor or as an infraction. It carries zero points. That last fact is the single most useful thing on this page, and we will come back to it.

Reckless driving

VC 23103 is driving with willful or wanton disregard for safety. If someone other than the driver is injured, it becomes VC 23104, which carries not less than 30 days and not more than six months in county jail, or a fine of $220 to $1,000, or both. A scraped knee is enough to get you there.

Hit and run with property damage

VC 20002 is a misdemeanor carrying two points. Note what the crime actually is. It is not the collision. It is leaving without identifying yourself. That distinction matters more than you would expect, and we explain why below.

The reduction that actually changes your life

Most defense pages talk about getting a charge “reduced” as though all reductions are the same. They are not. On these cases there is one specific move, and it is worth understanding why.

A 14601 conviction is two points. A 12500 conviction is zero points, and it can be knocked further down to an infraction. So moving a client from 14601 to 12500 does not just lighten a sentence. It takes them off the DMV’s negligent operator ladder entirely.

What gets you there is not an argument in court. It is homework done before the negotiation. Bryan’s practice on these is to work with the client to get a valid California license in hand first, and only then open the conversation with the District Attorney. When that happens, the usual landing spot is a 12500. Most of the time the case is dismissed outright. Worst case, it comes down to a 12500 charged as an infraction.

So if your license is suspended and you can clear the underlying hold, do it now, before your court date. A prosecutor looking at a defendant who has already fixed the problem is a different prosecutor than the one looking at a defendant who has not.

One thing that is different here from most criminal charges in Orange County: on suspended license, unlicensed driving and hit and run cases, outcomes do not vary much between the Harbor, Central, West and North Justice Centers. On DUI and on several other charges, the courthouse genuinely matters. On these, the prosecutors work with you at all four.

The one charge Orange County will not reduce

If your license was suspended because of a DUI conviction and you were caught driving, you are looking at VC 14601.2, and you should know going in that this is treated differently here.

On what a 14601.2 realistically resolves to

“The Orange County District Attorney’s Office treats these very harshly and does not like to reduce them down to anything. Most of the time they will offer you another suspended license section that is not a suspended license for DUI. It still holds two points, but it does not hold the mandatory jail time.”

Bryan R. Kazarian Criminal defense attorney, Santa Ana

Read that carefully, because it is an honest answer rather than a marketing one. On a 14601.2 the realistic win is usually not a dismissal and usually not a zero point charge (although we always fight for the zero point charge or dismissal). It is getting off the mandatory jail sentence. That is still a substantial result. It is just not the result the rest of these pages imply is available.

Hit and run: what changed, and what still works

Several Orange County defense pages still tell you that a hit and run can be resolved by civil compromise under Penal Code 1377, meaning you pay the other driver, they tell the court they are satisfied, and the case goes away.

That has not been the law since 2019. In People v. Dimacali (2019) 32 Cal.App.5th 822, the Court of Appeal applied the California Supreme Court’s holding in People v. Martinez (2017) 2 Cal.5th 1093 that the act constituting a 20002(a) offense is fleeing the scene, not the collision. Because the crime is the leaving, there is no matching civil claim to compromise. The property damage is a separate thing.

If you are reading a page that still offers you civil compromise on a hit and run, that page has not been updated in six years.

What does still work is paying restitution early and judicial diversion under Penal Code 1001.95. In our experience a 20002(a) misdemeanor is usually fixable. It gets dismissed, or it comes down to a benign charge, and what does it is restitution paid up front, or paid through the Orange County District Attorney’s Victim Witness office as a condition of diversion.

Two things kill that outcome, and both are worth knowing before you call anybody:

  1. No insurance, and no ability to pay restitution out of pocket. If the damage figure is too large for the client to cover, there is nothing to work with. Bryan calls this an outright deal killer.
  2. A long driving record. A history riddled with unlicensed driving, suspended license convictions, hit and runs or DUIs takes the compromise off the table.
Two cases

Past results do not guarantee a future outcome, and identifying details have been changed.

Case one · Driving on a suspended license An infraction citation that became a mandatory jail case, and ended at zero points
What he was facing
  • VC 14601.2(a), driving on a DUI-suspended license
  • Mandatory 30 days in the Orange County Jail
  • A fine of approximately $3,000
  • Two points on his DMV record
How it resolved
  • Charge changed to a VC 12500
  • No custody
  • Zero points on his DMV record
  • Still open to a further reduction to an infraction

A client came in with a citation for driving on a suspended license, written as an infraction. On its face it looked like a fine.

His record said otherwise. He had prior 14601 convictions and a prior DUI. We told him at the first meeting that there was a real chance the District Attorney would take a look at this one, and we monitored the citation to find out which way it went.

The DA reviewed it. They changed the charge from 14601(a) to 14601.2(a), driving on a license suspended for a DUI. With one prior conviction inside the lookback period, that carried a mandatory 30 days in the Orange County Jail plus a fine starting at $500 and assessments.

What we did
  • Worked with the client to get his driver’s license restored.
  • Negotiated with the District Attorney to strike the prior allegation.
  • Got the charge changed from 14601.2 to a 12500.

He went from a mandatory month in custody, an approximately $3,000 fine and two points on his record to a zero point charge. The reduction to 12500 also left the door open to knocking it down further to an infraction.

Case two · Reckless driving causing injury Reckless driving causing injury, dismissed and sealed
What she was facing
  • VC 23104(a), reckless driving causing bodily injury
  • Mandatory minimum 30 days in county jail
  • Two points on her DMV record
  • Her college enrollment and her immigration status
How it resolved
  • Judicial diversion granted under PC 1001.95
  • Speed awareness class, diversion fee, restitution to the victims
  • Six months clean, including no new infractions
  • Case dismissed and sealed

A young woman was driving through a neighborhood with a friend in the passenger seat. She took a corner, lost control, went up over the sidewalk, through a set of hedges and into a nearby park.

A young couple walking with their baby had to jump clear. The father, who was carrying the child, fell and scraped his knees. The child got a small scrape on the arm.

Those scrapes turned a bad afternoon into VC 23104(a), reckless driving causing bodily injury, with a mandatory minimum of 30 days in county jail. Beyond the custody exposure and the two points, she was facing consequences to her college enrollment and to her immigration status.

We worked with the court, the District Attorney and the victims themselves and persuaded the judge to grant judicial diversion under PC 1001.95. Her terms were a speed awareness class, a diversion fee, and restitution paid to the victims. She then had to stay clean for six months, including no new infractions, not just no new crimes.

She did. The case was dismissed and sealed.

Why this one matters beyond her case

Judicial diversion is available on Vehicle Code misdemeanors. It is not available on a DUI, and it is not available on domestic violence, stalking, or offenses requiring sex offender registration. Everything else is on the table if a judge can be persuaded, and a judge can grant it over the prosecutor’s objection.

The DMV is running its own case, and winning in court does not stop it

Your criminal case and your driving privilege are two separate proceedings on two separate clocks. Most people find this out too late.

The DMV runs the Negligent Operator Treatment System, and it counts points, not convictions. Their published thresholds are:

Every suspended license conviction is two points. So is a DUI, and so is a hit and run misdemeanor. Read the thresholds below with that in mind: two convictions inside a year puts you on the bottom rung.

1
2 in 12 months, 4 in 24, 6 in 36
Warning letter
2
3 in 12 months, 5 in 24, 7 in 36
Notice of intent to suspend
3
4 in 12 months, 6 in 24, 8 in 36
Probation for one year with a six month suspension

That suspension takes effect 34 days after the DMV mails the order, not 34 days after your court date. The DMV runs on its own clock.

That suspension takes effect 34 days after the DMV mails the order.

Now look at the point values again. A DUI is two points. Any of the four suspended license sections is two points. A hit and run misdemeanor is two points. Two of those inside twelve months and you are at the suspension threshold. A 12500 is zero, which is why the reduction described above is worth as much as it is.

Two things about these hearings that no competitor page mentions:

The DMV does not wait for your conviction.

On the DMV running ahead of the court

“The DMV does not always wait for you to have a conviction before they conduct a negligent operator hearing. You could not be convicted in court yet, your case pending, and the negligent operator hearing will still move forward. We have handled these when a client had pending vehicular homicide charges.”

Bryan R. Kazarian Criminal defense attorney, Santa Ana

And if the court case goes away, the DMV action does not go with it. Getting your criminal case dismissed is not a defense at the DMV. It is a separate hearing, on a separate record, and it has to be fought separately. We handle those hearings when we are retained on the related vehicular criminal case.

If you already missed your court date

A large share of the people who call us are not calling about a fresh citation. They are calling because they ignored one, and something has now happened.

What happens next depends on whether the original citation was a misdemeanor or an infraction, and the two outcomes are not remotely alike.

If it was a misdemeanor, the court can issue a bench warrant. That warrant does not expire on its own and it sits there until somebody deals with it. If you failed to appear on a citation you signed, the prosecutor can also add a charge under VC 40508.

If it was an infraction, there is no warrant. Warrants exist on misdemeanors and felonies. What you get instead is a hold placed on your license and a $100 civil assessment added under Penal Code 1214.1, on top of the original bail amount. The Orange County Superior Court also refers unpaid cases to an outside collection agency and can intercept your tax refund.

On the warrant, the practical question is whether you have to walk into a courtroom and risk being taken into custody. Usually you do not. We go in without you, put the case back on calendar, have the warrant recalled and set it for a pretrial so negotiations can start.

How fast that happens: we were hired on a Wednesday on a Harbor Justice Center matter and were in court Thursday. The warrant was recalled the next day after being hired and the client never appeared.

On misdemeanor driving cases generally, we appear on your behalf and you stay at work. That is standard for us on these, not an exception we make for certain clients.

When you do not need to hire us

Every other page you will read on this subject is built to make you feel like you need a lawyer. Here is where we think that is not true.

Infractions are not crimes. They carry no jail, you cannot be arrested for them, and they carry one point. That includes:

  • Failure to wear a seatbelt
  • Holding a phone while driving
  • Speeding under VC 22349 or VC 22350

Bryan’s answer when someone calls wanting to hire the firm on one of these:

On when not to hire a lawyer

“I would give that person a true and honest review and tell them that they don’t need our services, and they don’t need anybody’s services. They should ask for traffic school if they’re eligible and they haven’t been to traffic school in 18 months, or handle it themselves by paying the ticket. Obviously this advice is if they believe they were in the wrong and do not want to contest the facts of the case.”

Bryan R. Kazarian Criminal defense attorney, Santa Ana

So: clean record, no injury, no priors, straightforward infraction. Ask the court for traffic school if you are eligible and have not used it in the last 18 months. That gets the point off, though you still pay the fine and the traffic school fee. If it is a non-moving violation, just pay it and move on. There is nothing there for a lawyer to improve.

Call us when the box says misdemeanor, when there is an injury, when there is a collision you left, when your record has priors on it, or when you are not sure which of those you are looking at.

What everyone gets wrong

“It’s just a traffic ticket.” This is the mistake that creates the cases we end up fixing. A citation is a notice to appear. On a misdemeanor, that piece of paper is a criminal charge, and it does not stop being one because you decided it looked minor.

“I’ll just pay it and be done.” On a misdemeanor charge, paying is not settling a bill. It is resolving a criminal case, and what you are left with is a criminal conviction on your record.

“The citation says infraction, so I’m fine.” Covered at the top of this page. The citation is not the filing decision.

“They can’t prove I knew about the suspension.” Sometimes true, and it is the element that wins these cases. But the DMV keeps mailing records, and the prosecutor will use them. This is an argument to make with a lawyer, not an assumption to rely on.

Common questions

Driving offense questions, answered

The questions people actually ask in the first phone call, answered the way we would answer them on the phone.

Your record

Will this show up on a background check?

A misdemeanor conviction will. An infraction generally will not appear as a criminal conviction. This is the practical difference between the two and it is the reason the reduction fight matters. If you already have a conviction, ask us about expungement.

Can I get a suspended license charge dismissed outright?

Frequently, yes, if we can get you licensed before we negotiate. The exception is 14601.2, the DUI suspension section, where the realistic goal is avoiding the mandatory jail term then working toward a dismissal.

Is diversion available on a driving charge?

Judicial diversion under PC 1001.95 is available on Vehicle Code misdemeanors, and we have used it to get a reckless driving causing injury case dismissed and sealed. It is not available on a DUI.

Court, and whether you have to be there

Do I have to go to court?

On misdemeanor driving offenses, generally no. We appear for you.

Does my case get better or worse depending on the courthouse?

On these charges, not much. Suspended license, unlicensed driving and hit and run resolve similarly at Harbor, Central, West and North.

How fast can you deal with a warrant?

We have had a warrant recalled the day after being hired.

The DMV, which is a separate case

My court case got dismissed. Is my license safe?

No. The DMV's negligent operator action is separate and survives a dismissal. It has to be handled on its own.

These terms are used interchangeably to describe attorneys who defend people accused of crimes. Both criminal lawyers and defense attorneys provide the same services – representing clients facing criminal charges and protecting their legal rights throughout the legal process.

You should contact a criminal defense lawyer immediately after any arrest or if you learn you’re under investigation. Getting a criminal defense lawyer early can help protect your rights, potentially prevent charges from being filed, and ensure you don’t inadvertently harm your case by speaking without representation.

Understanding the difference between criminal justice and defense attorneys helps you choose the right legal representation for your situation.

Yes, the long-term consequences of a criminal conviction far outweigh attorney fees. A conviction can result in lost employment opportunities, damaged reputation, and potential jail time. Why criminal defense attorneys are worth the investment becomes clear when you consider the lifetime impact of a criminal record.

Criminal defense attorneys defend people accused of crimes, not necessarily criminals. Many clients are law-abiding citizens who made mistakes or are wrongly accused. How criminal defense attorneys protect the innocent is a fundamental part of ensuring everyone receives fair treatment under the law.
